Procedure
If a court approves a sentenced individual to participate in the weekender program and that individual desires to participate, he or she must be screened and found eligible by the detention center’s administration. Upon sentencing, the individual is required to report immediately to the Culpeper County Jail where he or she will be given an initial report date, the number of days to be served on weekends and the total weekender fee amount. The sentenced individual must return completed paperwork to the appropriate court.
The defendant will not be excused from serving any sentence, or portion of a sentence, as directed by the court unless he or she receives an authorization from the sentencing court prior to reporting to the detention center. Jail staff members do not have the authority to excuse anyone.
If the defendant fails to report to jail at the pre-determined time, he or she is not excused from reporting that entire weekend. If he or she fails to report for an entire weekend, he or she is required to report the following weekend.
If there is any deviation from pre-arranged report dates or times or any failure to comply with the weekender agreement, the sentencing court will be notified and the defendant will serve the remainder of the sentence consecutively.
Fees
In accordance with Virginia state code section 53.1-131.1, inmates serving weekend and nonconsecutive day sentences may be charged a set amount to defray their cost to the jail. This fee shall be used for the sole purpose of defraying the cost of the inmate’s stay.
The Culpeper County Jail has a set fee of $11.00 per day, or days, actually served. All weekender fees must be paid seven days prior to the defendant’s initial report date. Fees are collected at the detention center Monday through Friday only from 8 a.m. to 3 p.m. A money order made out to the Culpeper County Treasurer is the acceptable method of payment.
If the weekender fee is not paid in advance, the defendant will be required to serve the entire sentence consecutively as directed by the court. Any deviation from this policy shall only be made with the chief jailer’s approval.
Rules
- No money, hygiene items, food, tobacco products, extra clothing, magazines or other items are allowed in the detention center.
- Delivery of, or any attempt to deliver, any mail or messages into the detention center is prohibited.
- All prescription medications in their original container will be turned over to the medical department.
- Alcoholic beverages, drugs or anything containing illegal substances should not be consumed prior to reporting to jail. An Alco-Sensor may be employed upon admission to jail. Any degree of positive results will cause an immediate suspension from the weekender program and notification of such actions will be sent to the court.
Failure to meet the requirements weekender program and the Culpeper County Jail’s inmate rules and regulations, which is issued upon the inmate’s admission, will result in dismissal from the weekender program and will require that the inmate serve the remainder of the sentence consecutively.
